What if evidence of past treatment is found?

It goes in the report. Prior treatment is common and is not automatically a problem; what matters is whether there is current activity and whether the conditions that invited it are still there.

Can termites be in a brand-new house?

Yes. New construction is treated during the build, but treatments have a service life and disturbed soil around a new slab is exactly the environment subterranean termites move through.
